Terms of Service

These terms apply when you use swiftcater.ca, order catering through it, or list a restaurant on it. By placing an order you agree to them.

The short version. SwiftCater is a marketplace. The restaurant you order from prepares the food, sets its own menu and prices, and is responsible for what it serves. We take the order, collect payment, and pass the restaurant its share.

What SwiftCater is

SwiftCater is an online marketplace operated from Saskatchewan that connects customers with independent local restaurants offering catering. We are not a restaurant and we do not prepare food.

Each restaurant on SwiftCater is a separate business. It decides its own menu, prices, portion sizes, minimum order, catering hours, how much notice it needs, and which areas it delivers to. It is responsible for preparing your order and, unless a SwiftCater driver is used, for delivering it.

Orders

An order is a request to the restaurant until it is confirmed. Restaurants set lead times by headcount, so the dates and times you can choose are the ones that restaurant can genuinely meet.

You are responsible for the accuracy of what you enter — the event date and time, the headcount, the delivery address, and any access instructions. If an order cannot be delivered because the address or contact details were wrong, or because nobody was there to receive it, it may not be refundable.

Allergies and dietary requirements

Tell us in the order notes, and contact the restaurant directly for anything serious. Restaurants prepare food in kitchens that handle many ingredients, and cross-contamination is possible even where a dish is described as free of something.

Ingredient and allergen information comes from the restaurant. SwiftCater does not prepare food and cannot verify it. If you have a severe allergy, confirm directly with the restaurant before ordering.

Prices, fees and payment

Prices are set by the restaurant. Before you pay, checkout shows the full breakdown: the food, the restaurant's own service fee, any delivery fee, any gratuity, applicable taxes, and the SwiftCater platform fee.

The SwiftCater platform fee is 2.5% of the order for customers with an account, and 5% for guest checkout. Creating a free account removes the guest surcharge.

Payment is processed by Stripe. Card details are entered directly with Stripe and never reach SwiftCater. Where a restaurant has connected its own account, its share is transferred to it directly at the time of payment.

Changes, cancellations and refunds

Catering is prepared to order, often in large quantities and bought in specially. Cancellation terms are set by each restaurant and shown before you order. Once a restaurant has begun preparing an order, it may not be refundable.

To change or cancel, contact us as early as possible at owner@swiftcater.ca. If a restaurant cancels, or an order does not arrive, you are refunded in full.

If something is wrong with an order, tell us within 24 hours and we will work with the restaurant to put it right.

For restaurants

If you list a restaurant on SwiftCater, you confirm that you are authorised to do so, that you hold a valid food service permit and any other licence your operation requires, and that your menu, prices and allergen information are accurate.

You keep control of your menu, prices, availability, lead times, minimums and delivery areas. You are the seller of the food and responsible for preparing it safely.

SwiftCater retains its platform fee from each order and pays your share weekly, for the week in which the event was catered. A full breakdown of every payout is available in your dashboard.

Accounts

You can order as a guest or create an account. If you create one, keep your sign-in details secure and tell us promptly if you think someone else has access. We may suspend an account used fraudulently or in a way that harms restaurants, drivers or other customers.

Our responsibility

We will provide the service with reasonable care and skill. We do not prepare food and are not responsible for the quality, safety or accuracy of what a restaurant makes.

To the extent the law allows, SwiftCater's liability arising from an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and the terms in force when you place an order are the ones that apply to it.

Governing law

These terms are governed by the laws of Saskatchewan and the laws of Canada that apply there, and the courts of Saskatchewan have jurisdiction.
